Privacy notice

In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter “The Law”), we inform You (hereinafter “The Data Owner”) that Northware S.A. de C.V., OpenService S.A. de C.V., PlanNet Service S.A. de C.V. and Scatel S.A. de C.V. (hereinafter, jointly or interchangeably “Grupo Open”), with address at Regio Avenida No. 109, Colonia Regio Parque Industrial, C. P. 66633, Apodaca, Nuevo León, is responsible for collecting your personal data, for the use given to it and for its protection; always in accordance with the provisions of The Law and under the principles of lawfulness, quality, consent, information, purpose, loyalty, proportionality and accountability.

The personal data of The Data Owner collected by Grupo Open is: full name, unique population registry code (CURP), date of birth, address(es), marital status, email address(es), telephone number(s), tax information, professional and academic background, work experience, aptitudes, skills, abilities, photograph, information about your financial dependents, work and economic interests and expectations, as well as personal and professional references. Should Grupo Open request sensitive personal data from The Data Owner, the latter must authorize it in writing through a handwritten signature, electronic signature or another authentication mechanism.

Personal data may be requested by Grupo Open directly from The Data Owner through printed media, internet portals, emails, telephone calls, in-person interviews, among other lawful sources. Once Grupo Open communicates this Privacy Notice to The Data Owner, the latter grants their tacit consent by providing their personal data.

The processing of the personal data collected has the purpose of:

• Analyzing and, where applicable, providing or acquiring services and/or products offered or requested by Grupo Open to The Data Owner and vice versa.
• Promoting job offers from Grupo Open or Third Parties to The Data Owner.
• Promoting the Data Owner's independent professional services to Grupo Open or Third Parties.
• Communicating topics of interest from Grupo Open, on the understanding that they are useful to The Data Owner.
• Training and Statistical Analysis within Grupo Open.

Grupo Open maintains administrative, technical and physical security measures that allow the personal data of The Data Owner to be protected against damage, loss, alteration, destruction or unauthorized use, access or processing.

Should The Data Owner use Grupo Open's systems, websites or internet portals, these may collect data from The Data Owner such as browser type, operating system, websites visited, IP address, etc., through “cookies” or “web beacons”, among others. Grupo Open's systems, websites or internet portals may contain links to other external sites, whose content and privacy policies are not the responsibility of Grupo Open, so The Data Owner will, where applicable, be subject to the privacy policies of those other sites, without any liability on the part of Grupo Open.

Grupo Open does not transfer, disclose, distribute or commercialize the personal data of The Data Owner without their consent to Third Parties other than affiliates that operate under the same internal processes and policies and/or that have a contract entered into or to be entered into in the interest of The Data Owner, Grupo Open and a Third Party.

The Data Owner has at all times the right to access, rectify and cancel their personal data, as well as to oppose its processing or revoke the consent that they may have granted to Grupo Open for that purpose.

For this, The Data Owner must send their request in free-form text by email to the address datospersonales@open.mx, attaching documents that prove their identity and a detailed description of the data and rights they wish to exercise. This request will be answered by Grupo Open through the same medium within a period of no more than 10 business days.

Everything that The User creates and receives as responses under any form of survey or information collection will not be disclosed, sold, or displayed by The Company. All information belongs to The User for their own benefit and only They may exploit it. The only information that The Company will use for statistical purposes will be values relating to the sending or creation of surveys, since it is in the Company's interest to know the total number of surveys being created via the Service and also the total number of responses being received through the same Service.

Grupo Open reserves the right to modify this Privacy Notice, with the purpose of adapting, updating or improving it, or to comply with new legal provisions, internal policies, market practices, or requirements for the provision or offering of its services and/or products.
